voca.talk is a real-time language learning platform that connects students and teachers through live video sessions. Our service includes:

• Live video communication between users
• AI-powered real-time speech transcription
• Automatic translation of conversations
• Session history and learning tools

2. Account Registration

2.1 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use voca.talk. By creating an account, you confirm that you meet this requirement.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

3. Service Tiers

3.1 Free Tier

The free tier provides limited access to our platform features. Specific limitations are displayed in your account dashboard.

3.2 Premium Tiers

Premium features and pricing will be communicated separately. By subscribing to a premium tier, you agree to the applicable pricing and payment terms.

4. User Content

4.1 Your Content

"User Content" includes any audio, video, text, images, or other content you create, upload, or share through our service, including conversation recordings and transcripts.

4.2 Ownership

You retain ownership of your User Content. However, by using our service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Process and transmit your content to provide the service
• Store your content as necessary for the service
• Create transcriptions and translations of audio content
• Use anonymized data for AI model improvement (with your consent)

4.3 AI Training

Notice: We may use anonymized conversation data to improve our AI models. This helps us provide better transcription and translation services. You can opt out of AI training data collection in your account settings at any time.

5. Acceptable Use

5.1 Permitted Uses

You may use voca.talk for:

• Language learning and teaching
• Educational conversations
• Cultural exchange
• Any other lawful purpose consistent with these Terms

5.2 Prohibited Conduct

You agree NOT to:

• Use the service for any illegal purpose or activity
• Harass, abuse, threaten, or intimidate other users
• Share content that is defamatory, obscene, or offensive
• Impersonate another person or entity
• Use automated systems, bots, or scripts to access the service
• Attempt to circumvent security measures or access controls
• Interfere with or disrupt the service or servers
• Collect or harvest user data without consent
• Use the service to send spam or unsolicited communications
• Violate any applicable laws or regulations

6. Intellectual Property

voca.talk, including its design, features, and content (excluding User Content), is owned by Manuel Weichselbaum and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use our service for personal, non-commercial purposes in accordance with these Terms.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using voca.talk, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

Our service integrates with third-party services including:

• LiveKit (video streaming)
• OpenAI and Deepgram (AI transcription)
• Google services (analytics, AI translation)
• Firebase (authentication, database)

Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• Transcriptions or translations will be 100% accurate
• The service will meet your specific requirements
• Any defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Manuel Weichselbaum and voca.talk from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights
• Your violation of applicable laws

12. Account Termination

12.1 By You

You may delete your account at any time through your account settings or by contacting us at office@voca.talk.

12.2 By Us

We may suspend or terminate your account at any time if:

• You violate these Terms
• Your conduct harms other users or the service
• We are required to do so by law
• We discontinue the service

12.3 Effect of Termination

Upon termination, your right to use the service immediately ceases. We may retain certain data as required by law or for legitimate business purposes.

13. Changes to Terms

• Displaying an in-app notification

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and voca.talk regarding your use of the service.
